Air Navigation (Overseas Territories) Order (AN(OT)O) Open Accordion

Number Definition Remarks
0 The issue, refusal, provisional suspension or variation, variation or suspension or revocation of any certificate, licence, approval, permission, permit or authority applied for or held by any person under the AN(OT)O and/or AN(OT)(ES)O.  
00 In accordance with the provisions of the AN(OT)O and/or the AN(OT)(ES)O to exercise the right of access to aerodromes and to any place at which an aircraft has landed.  
1 To enter upon and inspect any aircraft; to request the production of documents and records required by the AN(OT)O or any regulations or requirements made thereunder to be produced at the request of the authorised person and to inspect and copy the same.  
2 In accordance with the AN(OT) O, to direct the operator or pilot in command not to permit it to make a flight and to detain the aircraft and the revocation of such a direction.  
3 To fulfil the regulatory functions of a Flight Operations Inspector in accordance with the provisions of the AN(OT)O and/or the AN(OT)(ES)O and/or the Regulatory Procedures Manual (RPM) Parts 1&2 and Part OPS and for that purpose to go upon any aerodrome (or any place at which an aircraft has landed) and any aircraft for the purpose of inspecting an aircraft or any document required under the said Orders.  
4 The grant, variation or revocation of any exemption from the provisions of the AN(OT)O in relation to a flying display or the dropping of articles, animals or persons from an aircraft.  
5 To fulfil the regulatory functions of a Dangerous Goods (DG) Inspector in accordance with the provisions of the AN(OT)O and/or the Regulatory Procedures Manual (RPM) Parts 1&2 and Part DGR including the examination, sampling and seizure of goods.  
6 The issue, refusal, revocation, provisional suspension or provisional variation or variation of any air operator’s certificate, or of any permission, approval or authority applied for or held under the AN(OT)O and/or AN(OT)(ES)O by any aircraft operator or pilot in command  
7 To fulfil the regulatory functions of an Airworthiness Inspector in accordance with the provisions of the AN(OT)O and/or AN(OT)(ES)O and/or the Regulatory Procedures Manual (RPM) Parts 1&2 and Part AIR and for that purpose to go upon any aerodrome and enter an aircraft factory or other premises, including premises used for any of the purposes of the maintenance, overhaul, repair or modification of an aircraft or any material parts or equipment installed or to be installed in an aircraft.  
8 The issue, refusal, revocation, provisional suspension or provisional variation or variation at the request of the holder, of any certificate, approval, permit, exemption or authority applied for or held by any person or organisation under the AN(OT)O or AN(ES)O in relation to the certification, maintenance and airworthiness of aircraft.  
9 To fulfil the regulatory functions of an Aviation Security (Av Sec) Inspector in accordance with the provisions of the AN(OT)O and/or the Aviation Security and Piracy (Overseas Territories) Order 2000 (as amended) and for that purpose to go upon any aerodrome or other place where Aviation Security regulatory oversight is required. Aviation Security staff only.
9a To fulfil the regulatory functions of an Aviation Security (Av Sec) Inspector for Tier 2 aerodromes only, in accordance with the provisions of the AN(OT)O and/or the Aviation Security and Piracy (Overseas Territories) Order 2000 and for that purpose to go upon any aerodrome or other place where Aviation Security regulatory oversight is required.  
10 To fulfil the regulatory functions of a Aeronautical Telecommunications and Instrument Flight Procedures Inspector in accordance with the provisions of the AN(OT)O and/or the Regulatory Procedures Manual (RPM) Parts 1&2 and Part ANS and for that purpose to go upon any aerodrome and enter any Air Traffic Control facility at which any aeronautical telecommunications and/or aeronautical navigation service is provided.  
11 The issue, refusal, provisional suspension or provisional variation or variation at the request of the holder, of any Aeronautical Telecommunications approval applied for or held by any person under the AN(OT)O.  
12 The issue, refusal, provisional suspension or provisional variation or variation at the request of the holder of an approval in respect of an Instrument Flight Procedure applied for or held by any person under the AN(OT)O.  
13 The grant, variation or revocation of any exemption from the provisions of the AN(OT)O or regulations made pursuant thereto in relation to any Instrument Flight Procedure.  
14 The issue, refusal, provisional suspension or provisional variation (or variation at the request of the holder) of any Flight Checking organisation approval applied for or held by any person under the AN(OT)O.  
15 The regulation of provision of Aeronautical Charts including access to any document or record in order to determine whether the service is being provided satisfactorily.  
16 The regulation of the provision of Aeronautical Information Service including access to any document or record in order to determine whether the service is being provided satisfactorily.  
17 To fulfil the regulatory functions of a Personnel Licensing Specialist in accordance with the provisions of the AN(OT)O and/or the Regulatory Procedures Manual (RPM) Parts 1&2 and Part PEL. ASSI Personnel Licensing Specialists only.
18 The grant, variation or revocation of any exemption from the provisions of the AN(OT)O or regulations made pursuant thereto which require a particular licence, validation, qualification, rating, or endorsement to be held.  
19 To fulfil the regulatory functions of an Air Traffic Services (ATS) Inspector in accordance with the provisions of the AN(OT)O and/or the Regulatory Procedures Manual (RPM) Parts 1&2 and Part ANS and for that purpose to go upon any aerodrome or other place at which an Air Traffic Control service or an aeronautical telecommunications service is provided, for the purpose of inspecting any equipment used or intended to be used in connection with the provision of such services and any document or record pertaining thereto.  
20 The conducting of a Competency check in relation to an Air Traffic Controller’s Licence or Flight Information Service Officer’s Licence and the provisional suspension or provisional variation of an Air Traffic Controller’s Licence or Flight Information Service Officer’s Licence.  
21 The regulation of the provision of Meteorological Services for aviation, including access to any document or record in order to determine whether the service is being provided satisfactorily.  
22 The regulation of the provision of Search and Rescue services for aviation including access to any premises, document or record in order to determine whether the service is being provided satisfactorily.  
23 To fulfil the regulatory functions of an Aerodromes Inspector in accordance with the provisions of the AN(OT)O and/or the Regulatory Procedures Manual (RPM) Parts 1&2 and Part AGA including the grant, variation or revocation of any exemption from the provisions of the AN(OT)O or regulations made pursuant thereto in relation to an aerodrome certificate.  
24 In accordance with the provisions of the AN(OT)O to direct a person having the management of an aviation fuel installation not to permit aviation fuel to be dispensed from that installation.  
25 In relation to a flight crew licence, the approval of a course of training or instruction, the authorisation of a person to conduct proficiency checks, examinations or tests and the approval of a person to provide a course of training or instruction.  
26 In relation to Air Traffic Control licensing, the approval of a course of training or instruction, the authorisation of a person or organisation to conduct examinations or tests and the approval of a person or organisation to provide a course of training or instruction  
Aviation Security and Piracy (Overseas Territories) Order ASP(OT)O Open Accordion

Number Definition Remarks
1 Inspection of:
(a) any aircraft registered or operating in the Territory, or
(b) any part of any aerodrome in the Territory, or
(c)  any land outside an aerodrome which is occupied for the purposes of a business by a person who –
(i)   also occupies (or appears to be about to occupy) land within an aerodrome for the purposes of that business, or
(ii)  is permitted (or appears to be about to be permitted) to have access to a restricted zone of an aerodrome for the purposes of the activities of that business, or any air navigation installation.

2 An authorised person carrying out an inspection under Authorisation Number 1 above shall have power to:
(a) subject any property found by him in the aircraft, part of the aerodrome or any property found, to such tests, or take such steps –
(i)   to ascertain what security practices or procedures are being followed, or
(ii)  to test the effectiveness of any security practice or procedure, or
(b) require the aircraft operator, aerodrome manager, authority responsible for an air navigation installation or occupier of the land to furnish information, as the authorised person considers necessary for the purposes of the inspection.

3 An authorised person for the purpose of exercising the powers in Authorisation Numbers 1 or 2 above shall have power to enter –
(a) an aircraft and to take all such steps necessary to detain it, or
(b) any building, works or land in the aerodrome, or
(c)  any building, works or land outside the aerodrome, or
(d) any air navigation installation.

Exception: Bermuda, Cayman and TCI - excluding the power to detain an aircraft under this function without prejudice to the exercise of any power under function.
4 An authorised person may give a detention direction in respect of an aircraft and may do anything expedient to ensure that the aircraft does not fly while the direction is in force including:
(a) entering the aircraft;
(b) arranging for another person to enter the aircraft;
(c)  arranging for a person or thing to be removed from the aircraft;
(d) using reasonable force;
(e) authorising the use of reasonable force by another person.
