Proposed changes to Air Navigation (Overseas Territories) Order and the Air Navigation (Overseas Territories) (Environmental Standards) Order will normally be available via this website. Comments received during the formal consultation process will be considered and, where appropriate, changes will be incorporated into the draft amendment to the legislation. Disindentified comments and our responses will be published in a log on this website following the formal consultation period. Commenters should note, though, that ASSI does not have the final say over the form and content of legislation, which is subject to UK legislative procedures.
Proposals to amend the Air Navigation (Overseas Territories) Order 2013
Following two stages of consultation in 2025 which have now closed, we have been working with the UK Department for Transport (DfT) on a new consolidated Air Navigation (Overseas Territories) Order. This would replace the 2013 Order and amend or introduce provisions across the following topics:
- Unmanned aircraft;
- Psychoactive substances;
- Safety data collection and provision;
- Search and Rescue;
- Governor powers and duties;
- Documents and records;
- Principal Place of Business; and
- Rules of the Air.
However, although we submitted final instructions to DfT in August 2025, the laying of this new Order has been delayed for reasons beyond our control. We have assessed that this delay will not impose risk to the Overseas Territories or ASSI.
